Sit Stay Wash™ Terms and Conditions

These Terms and Conditions memorialize and clarify policies and operating procedures that have governed the use of Sit Stay Wash facilities since opening.
Welcome to Sit Stay Wash, LLC (“Sit Stay Wash,” “we,” “us,” or “our”). These Terms and Conditions govern access to and use of all Sit Stay Wash locations, services, equipment, websites, mobile applications, memberships, access systems, and related offerings.
By accessing, entering, using, purchasing services from, or creating an account with Sit Stay Wash, you agree to comply with these Terms and Conditions.
1. Self-Service Facility
Sit Stay Wash operates self-service dog wash facilities that may be unmanned, remotely monitored, or unattended during operating hours.
Visitors are solely responsible for:
Their own safety and conduct
The safety and conduct of their pets
Any guests, minors, handlers, or accompanying individuals they bring into the facility
Proper use of all equipment, products, and supplies
Compliance with all posted rules, instructions, and safety notices
Sit Stay Wash does not provide pet supervision, grooming services, veterinary care, pet handling, or emergency response services.
2. Assumption of Risk
Use of a self-service pet wash facility involves inherent risks, including but not limited to:
Wet floors
Slips, trips, and falls
Dog bites or scratches
Equipment misuse
Loud noises from dryers
Allergic reactions or sensitivities
Interactions with unfamiliar animals or individuals
Exposure to common bacteria, viruses, allergens, or environmental conditions associated with shared pet care environments
All persons entering the facility do so voluntarily and assume all risks associated with their presence and use of the facility.
3. Pet Health and Behavior Requirements
Visitors are responsible for ensuring that pets entering the facility are suitable for a self-service environment.
Pets displaying aggressive behavior, excessive fear, illness, contagious conditions, or any behavior that may create a safety risk should not be brought into the facility.
Sit Stay Wash reserves the right to deny access or remove any pet or visitor whose conduct creates a safety concern.
4. Pet Control Requirements
Pets must remain under the control of their owner or handler at all times.
Unless actively secured inside a designated wash station, pets must remain on a leash.
Pets may not be left unattended within or outside the facility.
Visitors are responsible for preventing escapes and ensuring all entry doors, gates, and station restraints are used properly.
5. Access Credentials and Facility Entry
Access links, codes, memberships, accounts, mobile credentials, and other entry permissions are issued solely to the authorized user.
Access credentials may not be:
Shared
Transferred
Resold
Posted publicly
Used to admit unauthorized individuals
The account holder is responsible for all activity associated with their account or access credentials.
Sit Stay Wash reserves the right to suspend or revoke access at any time for safety concerns, misuse, nonpayment, unauthorized access, or violations of these Terms.
6. Facility Equipment and Property
Visitors agree to use all equipment, products, supplies, fixtures, and facility features only as intended and in accordance with posted instructions.
Unauthorized modification, tampering, misuse, damage, theft, or interference with any equipment or facility systems is prohibited.
This includes, but is not limited to:
Wash stations
Dryers
Hoses
Doors and locks
Payment systems
Access systems
Security equipment
Plumbing or electrical systems
7. Damage, Theft, and Financial Responsibility
Visitors are financially responsible for any damage, loss, theft, excessive cleaning, repairs, or replacement costs resulting from their actions, the actions of their pets, or the actions of any accompanying person.
Sit Stay Wash reserves the right to recover all associated costs, including administrative expenses, service fees, collection costs, and attorneys’ fees where permitted by law.
8. Code of Conduct
To maintain a safe and enjoyable environment, the following are prohibited:
Harassment or threatening behavior
Physical violence
Unsafe handling of pets
Disorderly conduct
Illegal activity
Vandalism
Theft
Unauthorized solicitation
Smoking or vaping inside the facility
Possession of hazardous materials or weapons
Visitors are expected to leave wash stations reasonably clean and remove pet waste, hair, trash, and personal belongings before departing.
9. Video Monitoring
For safety, security, operational, and loss-prevention purposes, Sit Stay Wash facilities may utilize video surveillance and remote monitoring systems.
By entering the facility, visitors acknowledge that video and audio recordings may be collected, reviewed, stored, and disclosed when reasonably necessary to:
Investigate incidents
Enforce facility policies
Protect persons or property
Respond to legal requests
Support insurance claims
10. Limitation of Liability
To the fullest extent permitted by Illinois law, Sit Stay Wash and its owners, members, managers, employees, contractors, affiliates, landlords, vendors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to:
Facility access
Facility use
Pet behavior
Equipment use
Property damage
Personal injury
Illness
Theft or loss of personal property
Service interruptions
If liability is imposed despite the foregoing limitations, Sit Stay Wash’s total liability shall not exceed the amount paid by the visitor for the applicable transaction giving rise to the claim.
11. Indemnification
Visitors agree to indemnify and hold harmless Sit Stay Wash and its affiliated parties from claims, losses, liabilities, damages, expenses, and costs arising from:
Their use of the facility
Their pet’s conduct
Violations of these Terms
Damage caused by themselves or accompanying individuals
Violations of applicable laws or regulations
12. Payments, Packages, Memberships, and Refunds
All purchases are subject to applicable pricing displayed at the time of purchase.
Unused wash time, memberships, packages, and promotional offers may be subject to expiration dates and specific program terms.
Except where required by law or expressly approved by Sit Stay Wash, purchases are non-refundable.
Sit Stay Wash reserves the right to modify pricing, memberships, packages, promotions, and operating policies at any time.
13. Service Availability
Sit Stay Wash does not guarantee uninterrupted access to facilities, equipment, software, payment systems, mobile applications, or access-control systems.
Services may be suspended, delayed, modified, or discontinued due to maintenance, emergencies, utility interruptions, technology failures, weather events, or circumstances beyond our reasonable control.
14. Privacy
Use of Sit Stay Wash websites, applications, and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
15. Right to Refuse Service
Sit Stay Wash reserves the right to refuse service, deny access, terminate memberships, suspend accounts, or remove visitors from the premises for any lawful reason, including violations of these Terms or behavior that may endanger people, pets, property, or facility operations.
16. Governing Law and Venue
These Terms shall be governed by the laws of the State of Illinois.
Any dispute arising from these Terms or the use of Sit Stay Wash facilities shall be brought exclusively in the state or federal courts located in Cook County, Illinois.
17. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Changes to These Terms
Sit Stay Wash may modify these Terms at any time.
Updated versions will be posted on our website and become effective upon posting. Continued use of Sit Stay Wash facilities or services constitutes acceptance of any revised Terms.
